TOP50 Corporate Index Terms & Conditions & Privacy Policy

Effective Date: 11 December 2024

By submitting, claiming, applying for, or maintaining a listing on the TOP50 platform, you acknowledge, confirm, and agree to be legally bound by the following Terms & Conditions and Privacy Policy.

  1. Firm Obligations & Representations

You represent and warrant that all information submitted or confirmed in connection with your firm’s listing, nomination, or application is accurate, complete, and current at all times.

You agree to:

• Provide truthful, lawful, and up-to-date information;
• Refrain from submitting any false, misleading, deceptive, or unlawful content;
• Promptly review any pre-listed information and notify TOP50 of any inaccuracies or required corrections.

TOP50 reserves the right to verify submitted information at its sole discretion.

1.1 Nomination and Application Policy

Self-nomination for inclusion in the TOP50 Corporate Index is strictly prohibited. Firms, including their owners, partners, employees, agents, or representatives, may not nominate themselves directly or indirectly.

Firms may, however, submit a self-application through TOP50’s official application process, which is expressly permitted and subject to separate eligibility criteria, evaluation procedures, and acceptance at TOP50’s sole discretion.

Any attempt to circumvent this restriction, including through third parties acting at the direction or influence of the firm, shall constitute a material breach of these Terms and may result in immediate rejection, suspension, or permanent suspension from the platform.

  1. Platform Rights & Authority

TOP50 reserves the absolute and unilateral right to:

• Modify, restrict, suspend, prohibit, or terminate any listing, access, or visibility;
• Enforce these Terms without prior notice where deemed necessary.

TOP50 shall not be liable for any loss, damage, or consequence arising from any suspension, restriction, or permanent suspension of a listing.

Certain firms may appear on the platform based on publicly available information. Such firms may request updates or removal, subject to TOP50’s review and approval.

  1. Free Listing, Trial & Visibility

TOP50 may, at its discretion, provide a complimentary or trial listing.

During the trial period, the firm may be visible and accessible to users of the platform. TOP50 does not guarantee client engagement, inquiries, or business outcomes during this period.

Pre-Listed Firms

Some firms may be displayed on TOP50 using publicly available data (including directories, websites, or credible sources). Submission or claim of a listing constitutes confirmation and authorization to manage, update, or amend such information.

  1. Listing Continuation, Renewal & Payment

Following the expiry of any free or trial listing:

• Continued visibility requires successful renewal and full payment;
• Listings not renewed may be temporarily restricted or suspended.

Failure to complete payment within the prescribed timeframe may result in permanent suspension of the listing without further notice.

All payments made to TOP50 are strictly non-refundable.

  1. Permanent Suspension & Enforcement

Listings may be permanently suspended, without reinstatement, under the following circumstances:

• Expiry of a free or trial listing without timely renewal or payment;
• Breach of these Terms & Conditions;
• Submission of false, misleading, or fraudulent information;
• Conduct deemed harmful to the integrity, credibility, or reputation of TOP50.

Permanent suspension results in complete removal from the TOP50 platform and any affiliated or associated networks. Reapplication, relisting, or reinstatement may be denied at TOP50’s sole discretion.

  1. Privacy Policy

Information We Collect

Contact Information: Name, email address, phone number, and company details;

Firm Information: Listing, ranking, and profile data;

Publicly Available Information: Data obtained from websites, directories, social platforms, or publications;

Analytics Data: Non-personal usage data collected via cookies and analytics tools.

Use of Information

Information may be used to:

• Evaluate, publish, and manage listings;
• Communicate regarding listings, compliance, or inquiries;
• Improve platform performance and content;
• Conduct audits, reviews, and quality control;
• Send updates or notices (where consent has been provided).

Public Information Use

Firms listed using publicly available data may request updates or removal by contacting office@topfifty.org. All requests are subject to review.

Information Sharing

TOP50 does not sell or rent personal data. Limited disclosure to trusted service providers may occur under strict confidentiality obligations.

Cookies & Tracking

Cookies and analytics tools may be used to enhance user experience. Users may disable cookies through browser settings.

Data Rights

You may request access, correction, or deletion of personal data by contacting office@topfifty.org.

Data Security

Reasonable technical and organizational safeguards are implemented to protect data from unauthorized access or misuse.

Privacy Policy Updates

TOP50 may revise this Privacy Policy from time to time. Updates will be published on the platform.

  1. Limitation of Liability

To the fullest extent permitted by law, TOP50 shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use of the platform, listings, or any enforcement action taken under these Terms, including permanent suspension.

  1. Dispute Resolution & Governing Law

Any dispute shall first be attempted to be resolved through good-faith mediation. Failing resolution, these Terms shall be governed by and construed in accordance with the laws of Malaysia, with exclusive jurisdiction vested in the courts of Kuala Lumpur.

  1. Amendments to Terms

TOP50 reserves the right to amend, update, or replace these Terms & Conditions at any time. Continued use of the platform constitutes acceptance of any revised Terms.
